1. Acceptance of Terms

By creating an account, accessing, or using the services provided by BelieveInAI LLC ("BelieveIn.AI", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Age Requirement: By creating an account, accessing, or using the Service, you represent and warrant that you are at least 13 years old. If you are under 13, you may not use the Service.

2. The Service

BelieveIn.AI provides an AI-powered Role Playing Game platform and Game Studio. The Service allows users to create campaigns, generate characters, and interact with AI Game Masters.

3. Intellectual Property and Ownership

3.1 Our Ownership (AI Generations)

Unlike traditional tools (like Photoshop), our Service actively makes creative decisions to generate stories, dialogue, world-building, and visual assets. Therefore, as between you and BelieveIn.AI, BelieveIn.AI owns all right, title, and interest in and to any AI-generated content (including text, images, and code) produced by the Service ("Platform Content").

3.2 Your User Content

You retain ownership of the specific text inputs, prompts, and original lore you manually write and submit to the Service ("User Content"). You grant us a worldwide, royalty-free license to use your User Content to provide the Service and to generate Platform Content.

3.3 The "Streaming License" (Your Rights)

We want you to share your adventures. BelieveIn.AI grants you a limited, non-exclusive, worldwide, royalty-free license to:

• Play the games for your personal enjoyment.
• Stream, record, and share your gameplay sessions on platforms like Twitch, YouTube, and TikTok.
• Monetize these streams and videos through standard platform ad revenue and subscriptions.

Reservations: You may not sell, license, or adapt the Platform Content for other commercial media (such as creating a TV show, movie, book series, or merchandise line based on the AI-generated characters or stories) without a separate written license agreement from BelieveIn.AI. We reserve all rights not expressly granted here.

4. Game Studio and Community Content

4.1 Creating and Sharing Games

You may use the Game Studio to create custom games and worlds. If you choose to publish your game ("Community Game"):

• You grant BelieveIn.AI a perpetual, irrevocable license to host, display, and allow other users to play your Community Game for free.
• You represent that you have the right to use any lore or concepts included in your game.

4.2 Visual Styles Generator & Indemnification

The Game Studio allows you to upload reference images to generate "Visual Styles."

• Ephemerality: We do not store your reference images after the style is generated.
• Your Warranty: You represent and warrant that you own or have the necessary licenses to any Reference Images you upload. You agree not to upload images that infringe on third-party copyrights (e.g., unauthorized movie stills, fan art) or rights of publicity.
• Indemnification: You agree to indemnify, defend, and hold harmless BelieveIn.AI and its officers, directors, and employees from any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, publicity, or privacy right. This defense and indemnification obligation will survive these Terms and your use of the Service.

5. Subscriptions and Payments

5.1 Subscription Plans

We offer various subscription tiers (e.g., Basic, Pro, Ultra). Each plan includes specific monthly allowances for "Turns" and "Studio Assets" as detailed on our pricing page.

• Reset: Allowances reset at the beginning of each billing cycle. Unused allowances do not rollover.
• Limits: If you reach your plan's limit, you will be unable to generate further content until the next billing cycle or unless you upgrade your plan.

5.2 Cancellation

You may cancel your subscription at any time via your account settings. Cancellations take effect at the end of the current billing cycle. You will retain access to paid features until that date.

5.3 No Refunds & EU Right of Withdrawal

All fees are non-refundable. We do not provide refunds or credits for partially used billing periods.

• For EU Customers: By starting to use the Service (e.g., playing a turn, generating an asset), you expressly acknowledge and agree that the digital content is being provided to you immediately, and you hereby waive your right of withdrawal (14-day cooling-off period) under European consumer protection laws.

6. Copyright Policy (DMCA)

We respect the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement by a user of our Service, please provide our Copyright Agent with the following information:

1. A physical or electronic signature of the copyright owner.
2. Description of the copyrighted work.
3. Description of where the infringing material is located on our Service.
4. Your contact information (address, telephone number, email).
5. A statement that you have a good faith belief that the use is not authorized.
6. A statement that the information is accurate and that you are authorized to act on behalf of the owner.

7. Conduct, Prohibited Use, and Moderation

You agree not to use the Service to generate, share, or upload content that:

• Is Illegal or Harmful: Content that is illegal, sexually explicit, pornographic, violent, or promotes illegal acts.
• Promotes Hate or Harassment: Content that engages in bullying, harassment, racism, hate speech, or discrimination against any individual or group based on race, religion, gender, sexual orientation, or any other characteristic.
• Violates Privacy or Rights of Publicity: Content that depicts, simulates, or impersonates real people (including celebrities, public figures, or private individuals) without their explicit written consent.
• Exposes Private Information: Content that includes real-world private addresses, phone numbers, or other sensitive personally identifiable information (PII) of any person.
• Infringes Intellectual Property: Content that infringes upon the copyright, trademark, or other intellectual property rights of others.
• Simulates Real-World Tragedies: Content that simulates or trivializes real-world tragic events, crises, or promotes misinformation.

You also agree not to:

• Attempt to reverse engineer the AI models or scrape data from the Service.
• Use the Service to train other AI models.

Right to Remove and Terminate (Unilateral Action):

We reserve the right to monitor, review, and remove any content (including User Content and Platform Content) and to suspend or terminate your account and access to the Service at our sole discretion, at any time, for any reason or for no reason, and without prior notice or liability to you. We are not required to provide a justification for any such removal or termination.

8. Disclaimers

AI Unpredictability: The Service uses Artificial Intelligence. Output may be unpredictable, inaccurate, or factually incorrect. Characters may "hallucinate" events. You acknowledge that this is a feature of the technology.

"As Is" Basis: The Service is provided "AS IS" without warranties of any kind, either express or implied, including merchantability or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, BelieveIn.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of your use of the Service.

10. Dispute Resolution, Arbitration, and Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

10.1 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted by JAMS or the American Arbitration Association (AAA), rather than in court. The arbitration shall take place in Los Angeles, California.

10.2 Class Action Waiver

You and BelieveIn.AI agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. To the extent this waiver is unenforceable under applicable law (e.g., in certain EU jurisdictions), this provision shall be severed, but the remainder of these Terms shall remain in force.

10.3 Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

11. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through the Service or via email. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
